About Traffic Offenses in New Jersey
Traffic Violations, Municipal Court Attorney, Morris County, New Jersey
New Jersey traffic laws exist to protect the rights and safety of all pedestrians and motorists. Many people do not think hiring an attorney to fight a traffic violation is worthwhile, but even minor traffic violations and municipal offenses can have a serious impact on your driving privileges and your criminal record.
We know that an officer issuing a citation or ticket may not take into consideration individual situations and circumstances such as obstructed views, unsafe road conditions, acts of other motorists that may have contributed to a traffic violation, or the possibility of faulty radar equipment. At the Law Offices of William D. Ware, Esq., we offer aggressive advocacy to protect the rights of our clients facing municipal court and traffic violations offenses.
Driving too slow: New Jersey law allows for some interpretation of the law and discretionary penalties for many cases involving traffic violations. For example, N.J.S.A. § 39:4-97.1 Slow speeds as blocking traffic, states: “No person shall drive a motor vehicle at such a slow speed as to impede or block the normal and reasonable movement of traffic except when reduced speed is necessary for safe operation or in compliance with law. L.1955, c. 220, p. 869, s. 3.”
Illegal or improper U turns: Drivers can be issued a ticket for making an illegal U turn. However, N.J.S.A. § 39:4-125 establishes that certain conditions involving location, visibility, and distance must be met for a violation to occur.
Failure to stop: Under N.J.S.A. § 39:4-144, drivers approaching an intersection marked with a stop sign must bring their vehicles to a complete stop within five feet of the nearest crosswalk or stop line. But signs can be obstructed from a driver’s field of vision by overgrown foliage, an illegally parked car or truck, or for other reasons.
